Carer Terms.
1. Introduction
These Terms of Service (“Terms”) govern the relationship between Eco Carers (“we,” “us,” or “our”) and self-employed carers (“you” or “Carer”) who provide care services through our platform. By registering and offering services via Eco Carers, you agree to comply with these Terms.
2. Definitions
- Client: An individual or entity seeking care services through the Eco Carers platform.
- Care Recipient: The individual receiving care services.
- Service Agreement: A contract between the Carer and the Client outlining the terms of the care services to be provided.
- Platform: The Eco Carers website and associated applications facilitating connections between Carers and Clients.
3. Eligibility and Registration
To register as a Carer with Eco Carers, you must:
- Be at least 21 years old.
- Have a minimum of two years’ professional care experience in the UK.
- Possess a valid Enhanced DBS check registered on the Update Service.
- Provide proof of the right to work in the UK as a self-employed individual.
- Hold a Care Certificate dated within the past three years.
- Supply two professional references from UK-based individuals.
- Complete the Eco Carers application process, including profile creation and verification.
4. Self-Employment Status
Carers engaged through Eco Carers operate as self-employed professionals. As such, you are responsible for:
- Managing your own tax affairs, including registration with HMRC.
- Maintaining appropriate insurance coverage, including public liability insurance.
- Ensuring compliance with all relevant laws and regulations pertaining to self-employment and care provision.
5. Service Agreements
Prior to commencing any care services, you must establish a Service Agreement with the Client, detailing:
- Scope and nature of services to be provided.
- Agreed-upon rates and payment terms.
- Schedule and duration of care.
- Any additional terms relevant to the care arrangement.
Both parties should retain a copy of the signed Service Agreement for their records.
6. Payments
All payments for services rendered must be processed through the Eco Carers platform. Key points include:
- Carers set their own hourly rates, subject to a minimum rate aligned with the National Living Wage.
- Eco Carers applies a service fee of 15% to each transaction, covering platform maintenance and support services.
- Payments are held securely and released to Carers within two working days after the completion of services, provided there are no disputes.
- Payments will be made once Eco Carers receive payment from the client
Off-platform payments, including cash transactions, are strictly prohibited and may result in removal from the platform and could result in a payment of £1000
7. Conduct and Professionalism
As a representative of Eco Carers, you are expected to:
- Deliver care services with professionalism, compassion, and integrity.
- Respect the privacy and dignity of Clients and Care Recipients.
- Communicate promptly and clearly with Clients regarding scheduling and care matters.
- Refrain from any form of discrimination, harassment, or abuse.
- Comply with all applicable laws, regulations, and industry standards.
Failure to adhere to these standards may lead to suspension or termination from the Eco Carers platform.
8. Confidentiality
You must maintain strict confidentiality regarding all personal and sensitive information obtained during the course of providing care services. This includes, but is not limited to:
- Personal details of Clients and Care Recipients.
- Medical histories and health information.
- Financial information.
Disclosure of confidential information without proper authorization is grounds for immediate termination and may result in legal action.
9. Feedback and Dispute Resolution
Eco Carers encourages open communication between Carers and Clients. In the event of a dispute:
- Attempt to resolve the issue directly with the Client in a respectful and professional manner.
- If unresolved, contact Eco Carers support for mediation assistance.
- Eco Carers reserves the right to investigate disputes and take appropriate action, which may include suspension or removal from the platform.
10. Termination
You may terminate your association with Eco Carers at any time by providing written notice. Eco Carers reserves the right to terminate your access to the platform for reasons including, but not limited to:
- Breach of these Terms.
- Receipt of substantiated complaints from Clients.
- Engagement in prohibited off-platform transactions.
- Failure to maintain required qualifications or documentation.
Upon termination, you must cease all use of the Eco Carers platform and return any materials or information belonging to Eco Carers.
11. Amendments
Eco Carers may update these Terms from time to time. Carers will be notified of significant changes via email or through the platform. Continued use of the platform after such updates constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
