Eco Carers – Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Eco Carers Platform and services, whether as a carer, care provider, or client. Please read these Terms carefully before registering or using the Platform.

By accessing or using any part of the Platform, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use our services.


1. About Eco Carers

Eco Carers Ltd (“Eco Carers”, “we”, “us”, or “our”) operates a digital platform (“the Platform”) that facilitates the connection between:

  • Carers: self-employed individuals offering care services; and

  • Care Providers/Clients: individuals or organisations seeking care services for themselves or others.

Eco Carers is not a care agency, employer, or care provider. We are solely a technology platform that connects independent carers with clients and/or care providers. All agreements, work arrangements, and payments are made directly between the carer and the care provider/client.


2. Definitions

  • “User”: Any person using the Platform, including carers, care providers, and clients.

  • “Carer”: A self-employed individual who offers personal care or support services via the Platform.

  • “Care Provider”: Any individual or organisation seeking to engage carers through the Platform.

  • “Client”: The end recipient of care services, who may or may not be the same as the Care Provider.

  • “Platform”: The Eco Carers website, mobile app, and any associated services provided by Eco Carers Ltd.


3. Role of Eco Carers

  • We do not employ carers.

  • We do not supervise, direct, or control carers in any manner.

  • We do not enter into or enforce contracts between carers and care providers.

  • We are not responsible for the quality, legality, safety, or appropriateness of any care provided.

Eco Carers merely facilitates introductions and communication between parties.


4. Self-Employed Status of Carers

All carers registered on the Platform acknowledge that they are self-employed contractors. By using the Platform, carers confirm and agree that:

  • They are responsible for their own tax, national insurance, and business registration.

  • They are not entitled to employment benefits such as sick pay, holiday pay, or pensions.

  • They operate independently and are responsible for accepting or declining care engagements.

Eco Carers shall not be held liable for any tax or employment-related obligations or disputes.


5. User Eligibility and Account Obligations

To register as a user on the Platform, you must:

  • Be over 18 years of age.

  • Provide accurate, truthful, and complete information.

  • Maintain up-to-date account details.

  • Not use the Platform for any illegal or unauthorised purpose.

Carers must additionally:

  • Provide proof of valid right to work in the UK.

  • Possess an Enhanced DBS certificate.

  • Have any required training, qualifications, and insurance appropriate to the services offered.

Eco Carers reserves the right to suspend or terminate any user account for breach of these Terms.


6. Background Checks and Safeguarding

Eco Carers may conduct basic vetting (e.g., DBS check confirmation and ID verification), but we:

  • Do not guarantee the character, competence, or credentials of any User.

  • Are not liable for safeguarding failures, abuse, negligence, or any criminal acts.

Safeguarding responsibility lies fully with care providers and clients. All Users must conduct their own checks and assessments prior to engaging carers.


7. Insurance and Liability

Carers must ensure they have suitable public liability and professional indemnity insurance to cover the services they provide.

Eco Carers:

  • Is not liable for injury, loss, damage, financial dispute, or misconduct by any User.

  • Provides no warranties regarding the care arranged or the conduct of Users.

  • Disclaims all responsibility for any disputes, outcomes, or arrangements made between parties.


8. Payments and Fees

For Carers:

  • Carers set their own hourly or per-session rates.

  • Carers invoice or receive payment directly from the care provider.

  • Eco Carers does not handle or guarantee payments unless a specific arrangement is agreed.

For Care Providers:

  • You must pay carers promptly and in full for all services rendered.

  • Late or withheld payments may result in account suspension or legal referral.

  • Eco Carers accepts no liability for disputes over payments not processed through the Platform.


9. Platform Fees

Eco Carers may charge service or subscription fees for access to the Platform or use of specific features. All fees will be clearly displayed or agreed in advance.

We reserve the right to modify pricing at any time, with reasonable notice to Users.


10. Cancellations and Disputes

Eco Carers is not responsible for cancellations, no-shows, or scheduling issues. These must be resolved directly between the involved parties.

We may assist with communication or dispute resolution on a goodwill basis, but have no obligation to mediate or enforce outcomes.


11. Conduct and Behaviour

All Users must:

  • Act respectfully and lawfully at all times.

  • Refrain from harassment, discrimination, or abuse.

  • Use the Platform only for legitimate, legal care-related purposes.

Eco Carers reserves the right to remove any User or content that violates these standards or brings the company into disrepute.


12. Data Protection and Privacy

We process personal data in accordance with UK GDPR and our [Privacy Policy]. By using the Platform, you consent to the collection, use, and storage of your data as described.

We do not sell your data to third parties.


13. Intellectual Property

All content, trademarks, logos, and software on the Platform remain the property of Eco Carers Ltd or its licensors. Users may not copy, distribute, or commercially exploit any part of the Platform without written permission.


14. Termination of Use

We reserve the right to:

  • Terminate or suspend access to the Platform at any time, with or without cause.

  • Remove content or profiles that breach these Terms.

  • Cooperate with legal authorities if unlawful activity is suspected.

Users may close their accounts at any time via account settings or by contacting support.


15. Legal Disclaimer and Limitation of Liability

To the fullest extent permitted by law:

  • Eco Carers excludes all warranties (express or implied) relating to the use of the Platform.

  • We do not accept responsibility for loss of earnings, reputational damage, personal injury, or any indirect or consequential losses.

  • Our liability to any User in connection with these Terms or the Platform shall be limited to £100.


16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
